if this is indie i wish this guy was in indie game battle (pound) so i don't work for the game creator but does he have the rights to use him? if i'm accidentally breaking a newgrounds rule i am VERY sorry

Don't sweat it, dude! Nobody's breaking any rules. This game is most certainly indie. I don't know the Indie Game Battle developers either, but if he were to contact me, I'd gladly let them use Pound. I'm not sure if they're even still working on the game, though.
